Your AAUP-SC opposes H.4756 and expresses serious concerns about the bill’s vague enforcement language.

Surveillance
While this bill claims to protect privacy, it subjects everyone to surveillance in the bathroom. All faculty, students, staff, and campus visitors deserve to use bathrooms without harassment.
Unrealistic cost estimates
This bill requires that colleges and universities provide one single-user bathroom in each building, yet many campus buildings do not already have a single-user facility. How much will replumbing every campus cost? The fiscal impact statement says zero, but we don’t believe it.
Potential Liabilities
This bill threatens severe penalties for campuses that “fail to take reasonable steps to prohibit use of a multi-user facility by someone of a different biological sex”: loss of state funds as well as private lawsuits. What are reasonable steps? How much
bathroom surveillance will satisfy the “reasonable steps” standard and protect colleges and universities from litigation?
Your AAUP-SC encourages faculty, staff, students, alumni, and members of the community to communicate their concerns to campus administrations and contact their state legislators about the unreasonable burdens placed on individuals and institutions by this bill.
